The Mold industry is an ever changing and evolving industry like any science based business.
Buyers market:
Buyers are walking, to the next home, because unqualified mold inspectors are labeling homes with a "mold problem".
Do NOT assume your inspector is qualified or insured.
With buyers few and far between it is even more important that you check your mold inspectors credentials.
Do you really want an
inspector who just had a 1 or 2 day mold class performing your mold
assessment?
Gov. Crist signed a new mold law to protect the public, too many inspectors need insurance, training and experience.

MOLD INSPECTIONS
What consumers should
require of their mold inspector until the New Florida Mold Law becomes effective:
Mold inspectors
should have "mold specific" Errors & Omissions insurance. This type of insurance
is most often issued for the inspector not for the company. (This is required in new mold law)
468.8421 Insurance.-
(1) A mold assessor shall maintain
general liability and errors and omissions insurance coverage in an amount of not less than $1,000,000.
Mold inspectors
should identify sources of mold and water intrusion within the mold inspection report.
(This is required in new mold law)
468.8411 Definitions:
(3) "Mold assessment" means a process performed by a mold assessor that
includes the physical sampling and detailed evaluation of data obtained from a building history and inspection to formulate
an initial hypothesis about the origin, identity, location, and extent of amplification of mold.
Mold
inspectors should have written or electronic agreement that must be signed including the scope of work to be performed. (This is required in new mold law)
468.8422 Contracts. - A contract
to perform mold assessment or mold remediation shall be in a document or electronic record, signed or otherwise authenticated
by the parties.
Mold inspector should not perform mold cleanup / remediation on structure their company
performed mold inspection / assessment on in the last 12 months. (This is required in new mold law)
468.8419 Prohibitions; penalties.-
(d) Perform or offer to perform any mold remediation to a structure on which
the mold assessor or the mold assessor's company provided a mold assessment within the last 12 months.

Note:
1 It is estimated
only 1 out 12 mold inspectors have "mold specific" E&O insurance. (Home
Inspector E&O does not cover MOLD)
Your Mold Inspector probably does NOT have the mold E&O that will be required
in our new law and you never ask. This is just one of the reasons for the new mold law signed by Govenor Crist to protect
the public.
2. Mold test is not the same as a mold inspection.
3. Mold test alone, Limited sampling or mold screening
are not used to determine if home has mold problem, they are used to determine if you need a mold inspection. (Home inspectors sell these as mold inspections, client should read
agreement.)

New Florida Mold Law
In a effort to protect the citizens of Florida,
Florida Governor Crist signed Mold / Inspection legislation (SB2234) into law. The new law will regulate the Mold Inspection
industry and Home Inspection businesses and individuals.

the consumer should understand is that Mold Inspectors and Home Inspectors are two
different professions, with separate licenses and regulations.
The new Florida mold law is expected to eliminate many of the home inspectors that now claim to
provide mold inspections from the mold industry. Due to lack of training and experience along
with the ability to get the $1 million mold Errors and Omissions insurance required in the new law.

What Now?
Until the new law becomes
effective, or the FL DBPR issues the qualified individuals a license.
What should be done:

Step 1
First-line mold screening performed by home inspectors is to get preliminary information on whether a mold problem
may exist and further investigation is warranted.
Step 2
A professional mold inspector
(CIE or CIH) will determine if property has a mold/moisture problem, identify and document the sources and write recommendations
for corrections.
Step 3
Remediation Company will
clean up mold problem following the recommendations of the CIETM(Certified
Indoor Environmentalist) or CIH (Certified Industrial Hygienist) based on "IICRC S520 Standard for Mold Remediation.
Step 4
Clearance inspection and testing is performed by a CIETM or CIH to ensure mold clean up was
done properly. Home Inspectors should not do Clearance inspections or testing unless they are qualified to write
remediation specification or protocols and carry "mold specific" Errors and Omissions Insurance.
NOTE:
LIABILITY for job passes to the person who performed the Clearance inspection. MOLD specific Errors and Omission insurance is NOT the same as Home Inspector Insurance.
Many companies form a corporation and then just close company when liability issues arise. New
law will require $1 million mold E&O, this expected to eliminate many home inspectors from the mold business.
